This website is operated by BALI AGA, INC., doing business as BaliAga Beauty (“BaliAga,” “we,” “us,” or “our”).
BaliAga operates this website and online store, including all related information, content, features, tools, products, and services offered through the website (collectively, the “Services”). Our store is hosted and powered by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.
These Terms of Service (“Terms”) govern your access to and use of the Services and your purchase of products from BaliAga.
By visiting, browsing, interacting with, or purchasing from our website, you agree to be bound by these Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional policies referenced in these Terms.
If you do not agree to these Terms, you must not access or use the Services.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you have the consent of a parent or legal guardian where required by law.
You agree to provide current, complete, and accurate information when creating an account, placing an order, or communicating with us.
You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account.
You may not sell, transfer, assign, or license your account to another person.
We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
SECTION 2 — PRODUCT INFORMATION AND INTENDED USE
We make reasonable efforts to display and describe our products accurately. However, product packaging, labels, colors, dimensions, and appearance may vary slightly from photographs or displays on your device.
Product descriptions, ingredients, packaging, pricing, and availability may be updated without prior notice.
BaliAga hair oils, applicators, and related products are intended for cosmetic and personal-care use only. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Information on our website is provided for general educational and product-information purposes and is not medical advice.
Individual experiences may vary depending on hair condition, scalp condition, styling practices, product use, and consistency.
You are responsible for:
• Reviewing the product label and ingredient list before use
• Following all directions and warnings
• Performing a patch test where appropriate
• Avoiding contact with the eyes
• Discontinuing use if irritation or an adverse reaction occurs
• Consulting a qualified healthcare professional if you have a medical condition, allergy, pregnancy-related concern, or persistent scalp problem
We reserve the right to modify or discontinue any product and to limit product quantities by customer, household, geographic location, or order.
SECTION 3 — ORDERS AND ORDER ACCEPTANCE
Placing an order constitutes an offer to purchase products from BaliAga.
Receipt of an order-confirmation email does not necessarily mean that your order has been accepted. We reserve the right to accept, reject, limit, or cancel an order for reasons including:
• Product unavailability
• Pricing or listing errors
• Suspected fraud or unauthorized payment
• Unauthorized resale activity
• Shipping restrictions
• Violation of these Terms
• Inability to verify customer or payment information
An order is accepted when we confirm fulfillment or shipment, unless applicable law provides otherwise.
If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.
Please review your order carefully before submitting it. Once fulfillment has begun, we may be unable to change or cancel the order.
Products purchased through our store are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.
SECTION 4 — PRICES, DISCOUNTS, AND PAYMENT
All prices are displayed in the currency shown at checkout.
Prices, discounts, bundles, free gifts, and promotional offers may change without notice.
The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious errors.
Unless expressly stated otherwise, listed prices do not include:
• Sales tax
• Shipping charges
• Customs duties
• Import taxes
• Brokerage charges
• Other governmental fees
Applicable charges will be displayed at checkout when available.
Promotional offers may be subject to separate conditions, including eligibility requirements, expiration dates, quantity limits, and exclusions. If promotional terms conflict with these Terms, the promotional terms will govern for that promotion.
You represent that:
• The payment information you provide is accurate
• You are authorized to use the selected payment method
• The payment provider will honor the charges
• You will pay all amounts shown at checkout
We may use third-party payment processors to complete transactions. Your use of those payment services may also be governed by the processor’s terms and privacy policy.
SECTION 5 — SHIPPING AND DELIVERY
Orders are processed and delivered according to our Shipping Policy.
Any processing, shipping, or delivery time shown on our website is an estimate unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including:
• Carrier delays
• Severe weather
• Holidays
• Customs processing
• Incorrect or incomplete addresses
• Remote-location service limitations
• Supply interruptions
• Events of force majeure
Customers are responsible for providing a complete and accurate shipping address.
If we determine that we cannot ship an order within the timeframe originally stated, we will provide an updated estimate and, where required by applicable law, offer the customer the opportunity to consent to the delay or cancel the unshipped order for a refund.
Risk of loss will be handled according to the delivery status, carrier investigation, our Shipping Policy, and applicable law.
Detailed rules concerning lost packages, packages marked delivered, address errors, returned-to-sender packages, and damaged shipments are contained in our Shipping Policy.
SECTION 6 — RETURNS, REFUNDS, AND SATISFACTION GUARANTEE
Returns and refunds are governed by our Return and Refund Policy.
Our standard return policy and 90-Day Satisfaction Guarantee have different eligibility requirements.
In general:
• Eligible unopened and unused products may qualify for a standard return
• One opened bottle of BaliAga Kemiri Oil may qualify under the 90-Day Satisfaction Guarantee
• Opened or used applicators are generally not returnable for hygiene reasons unless damaged or defective
• Products returned without prior authorization may not be accepted
• Shipping charges are generally non-refundable unless required by law or the order arrived damaged, defective, or incorrect
The 90-Day Satisfaction Guarantee is a customer-satisfaction policy. It does not guarantee a particular hair-growth, medical, or cosmetic result.
Eligibility requirements, exclusions, evidence requirements, bundle adjustments, return-shipping responsibilities, and refund timelines are described in our Return and Refund Policy.
Nothing in these Terms limits any consumer right that cannot legally be excluded or waived.
SECTION 7 — DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS
You should inspect your order promptly after delivery.
If an item arrives damaged, defective, leaking, incomplete, or incorrect, contact us at support@baliagabeauty.com and provide:
• Your order number
• A description of the issue
• Photographs of the product
• Photographs of the packaging
• Photographs of the shipping label
• Any other information reasonably requested to evaluate the claim
Please retain the product and packaging until your request has been reviewed.
Approved claims may be resolved through replacement, refund, store credit, or another appropriate remedy.
SECTION 8 — PERSONAL INFORMATION AND PRIVACY
Our collection, use, disclosure, and protection of personal information are governed by our Privacy Policy.
Because our store is hosted by Shopify, Shopify and other authorized service providers may process information needed to operate the store, process payments, prevent fraud, fulfill orders, provide customer support, analyze performance, and improve the Services.
Your information may be processed in countries other than your country of residence, as described in our Privacy Policy.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
SECTION 9 — INTELLECTUAL PROPERTY
All content made available through the Services, including trademarks, logos, brand names, text, graphics, photographs, videos, product designs, packaging, reviews, software, and page layouts, is owned by or licensed to BALI AGA, INC. and is protected by applicable intellectual-property laws.
You may access and use the Services only for personal and non-commercial purposes.
Without our prior written permission, you may not:
• Copy or reproduce website content
• Republish or distribute content
• Modify or create derivative works
• Use product photographs or videos commercially
• Scrape or extract website data
• Use BaliAga trademarks, branding, or packaging
• Misrepresent yourself as affiliated with BaliAga
No license or ownership right is transferred to you except as expressly stated in these Terms.
SECTION 10 — REVIEWS, PHOTOS, AND USER CONTENT
If you submit a review, photograph, video, testimonial, suggestion, comment, or other content (“User Content”), you represent that:
• The content is truthful and reflects your genuine experience
• You own or control the necessary rights
• The content does not violate another person’s rights
• Any compensation, free product, commission, or incentive has been properly disclosed
• The content is not unlawful, deceptive, defamatory, obscene, or harmful
• The content does not contain malware or malicious code
By submitting User Content, you grant BALI AGA, INC. a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, publish, display, distribute, adapt, and promote that content in connection with our business and marketing.
We may moderate or remove User Content that violates these Terms, but we are not required to monitor every submission.
We do not accept responsibility for statements made by customers or third parties.
SECTION 11 — THIRD-PARTY TOOLS AND SERVICES
The Services may include tools, applications, payment systems, analytics services, marketing services, or other functionality operated by third parties.
Third-party services are provided subject to the applicable provider’s terms and privacy practices.
We do not control every third-party service and are not responsible for its independent acts, availability, content, security, or performance, except where liability cannot legally be excluded.
Your use of third-party tools is at your own discretion and risk.

We do not control or endorse all third-party websites and are not responsible for their content, accuracy, products, services, security, or privacy practices.

Questions or disputes relating to a third-party product or service should be directed to the applicable third party.
SECTION 13 — RELATIONSHIP WITH SHOPIFY
BaliAga Beauty is powered by Shopify, which enables us to provide the Services.
However, purchases made through our store are transactions directly between you and BALI AGA, INC., doing business as BaliAga Beauty.
Shopify is not the seller of BaliAga products and is not responsible for product fulfillment, customer service, refunds, product claims, injuries, losses, or damages arising from transactions between you and BaliAga.
To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from your transaction with BaliAga.
SECTION 14 — PROHIBITED USES
You may not use the Services:
• For unlawful, fraudulent, or malicious purposes
• To violate any law or regulation
• To infringe intellectual-property, privacy, or publicity rights
• To impersonate another person or entity
• To submit false or misleading information

If an order is cancelled because of an error after payment, the applicable amount will be refunded.

We do not warrant that:

• A product will produce the same result for every customer
• Product colors or appearance will be identical on every screen
• Third-party tools will always remain available
Any implied warranties that cannot legally be excluded remain in effect for the minimum period required by law.
Nothing in this section limits rights that cannot legally be waived.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, BALI AGA, INC. and its owners, directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the Services or products.
This includes, where permitted by law, loss of profits, loss of revenue, loss of data, loss of opportunity, or replacement costs.
These limitations do not apply where liability cannot legally be excluded, including liability arising from fraud, willful misconduct, gross negligence, or other mandatory consumer protections.
SECTION 18 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless BALI AGA, INC., Shopify, and their respective affiliates, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:
• Your violation of these Terms
• Your unlawful use of the Services
• Your violation of another person’s rights
• User Content submitted by you
• Fraudulent or unauthorized conduct attributable to you
We will provide reasonable notice of an indemnifiable claim and may participate in or control the defense as permitted by law.

We may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent activity, threaten the security of the Services, or misuse the website.
Termination does not affect obligations or liabilities incurred before termination.
Sections that by their nature should survive termination will remain effective, including intellectual property, User Content licenses, disclaimers, limitation of liability, indemnification, and governing law.
SECTION 20 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.

Failure to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and BaliAga concerning the Services and supersede prior communications relating to the same subject matter.
SECTION 22 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, corporate restructuring, or transfer of the business, subject to applicable law.
SECTION 23 — GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising from the Services will be governed by the laws of the State of California and applicable federal laws of the United States, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights or laws that require otherwise, disputes will be brought before the competent state or federal courts located in Los Angeles County, California, United States.
You and BALI AGA, INC. consent to the jurisdiction and venue of those courts.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The current version will be posted on this page with an updated effective date.
Where required by law, we will provide notice of material changes.
Your continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.
